JUVENILE IN POSSESSION OF A LOADED FIREARM
Case: Police responded to a verbal altercation between two males at San Francisco gas station. Clients boyfriend was determined to be one of the males involved, she was contacted at the scene and was found to be in possession of a loaded and concealed firearm.
Result: Our firm was able to demonstrate to the judge that the client was only in possession of the firearm for moments. We were able to present evidence through gas station surveillance footage that the boyfriend handed our client the gun moments before the police arrived. Client admitted to 6 months of informal probation. All charges to be dropped upon completion of probation.
DUI DRUGS AND ALCOHOL
Case: Client pulled over for running a red light. Arrested on suspicion of driving under the influence of drugs and alcohol.
Result: Our firm worked in close connection with expert toxicologists, case dismissed at trial.
MAN ARRESTED FOR PIMPING
Case: Client was arrested for felony pimping and pandering. The San Mateo County district attorney sought to bring in proof, in the form of text messages, from our client allegedly coercing a woman to work as a prostitute for him.
Result: Our firm thoroughly analyzed the cell phone data relied upon by the District Attorney’s Office. Using forensic techniques were able to show that there was no connection between our client and the cell phone in question. Case dismissed at trial.
FELONY DOMESTIC VIOLENCE
Case: Client was arrested for felony domestic violence, domestic violence leaving bodily injury and false imprisonment. Our clients wife claimed that he had beaten her and thrown her into a bathtub. Police believed her injuries corroborated her story and our client was arrested.
Result: After thorough investigation our firm was able to uncover prior police reports in which the alleged victim threatened to make false allegations against a police officer. We were also able to establish that the alleged victim was a chronic alcoholic whose injuries were more consistent with multiple falls than with domestic abuse. Case dismissed.
SAN DIEGO MAN ARRESTED FOR BEING DRUNK IN PUBLIC AND POSSESSION OF A LOADED FIREARM
Case: Police responded to a call of a drunk man at a San Diego beach brandishing a gun. Police contacted our client who was arrested and charged with misdemeanor drunk in public and misdemeanor possession of a loaded firearm.
Result: Our firm worked with mental health professionals. We were able to convince the court that our client was a former marine who was honorably discharged and was suffering from post traumatic stress disorder. The court placed our client on one year of diversion and at the close of the year all charges were dismissed.
BATTERY IN SAN MATEO
Case: Our client was arrested on suspicion of battery in the front yard of his home. Client was approached by a man whom he did not know. He told the man to get off his property. When the man refused our client allegedly hit him with a steel rake.
Result: Our firm worked with the client and investigators to gather witness statements. We were able to show that client was not the aggressor and was acting in self defense. The alleged victim had a history of violence and was heard making threats. Case dismissed.
PETTY THEFT
Case: Our client was arrested for petty theft at a Santa Jose mall. He was alleged to go into a changing room with merchandise and his own empty laptop bag. When he exited it was determined that the bag was full of stolen merchandise. A foot chase began and the laptop bag was left behind. Inside the bag was a resume with the client’s name and information along with the merchandise.
Result: We took the case to trial and mounted a successful mistaken identity defense. The jury hung and the prosecutor elected not to refile the case. Charges dismissed.
POSSESSION OF DRUGS
Case: Client was contacted by the police outside of a bar late one night. The police asked for consent to search which the client gave. Police found he was in possession of cocaine.
Result: At trial we successfully argued that the client was not knowingly in possession of cocaine, and that if he were he would not have given consent to search. The jury hung and the case was dismissed after the district attorney decided not to re-try the case.
DOMESTIC VIOLENCE AND FALSE IMPRISONMENT
Case: Client was arrested for domestic violence after the alleged victim claimed he hit her and would not let her leave their apartment in San Francisco.
Result: Our firm was able to show that the victim was lying in order to get a visa for immigration purposes. Case dismissed.
MULTIPLE COUNTS OF FELONY FRAUD
Case: Our client was charged with taking over $50,000 in fraudulently obtained welfare benefits.
Result: We were able to get the charges reduced to a single misdemeanor conviction saving the clients job and housing. No jail time.
